Terms of Service

Welcome to Ombaverse. By accessing or using our platform at ombaverse.com (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

1. Who Can Use Ombaverse

You must be at least 13 years old to use Ombaverse. If you are between 13 and 17, you must have your parent or guardian's permission. You must be at least 18 to access mature-rated content or to receive payments.

2. Your Account

You are responsible for maintaining the security of your account and all activity under it. You agree to provide accurate information and to keep it updated. We may suspend or terminate accounts that violate these Terms.

3. Your Content — You Own It

You retain all ownership rights in the content you create and upload to Ombaverse. Ombaverse does not claim ownership of your stories, art, scripts, or other creative works (“Your Content”).

By uploading content to Ombaverse, you grant us a non-exclusive, revocable, worldwide license to host, display, distribute, promote, cache, reformat, and store Your Content as necessary to operate and promote the Service. This license exists only for as long as Your Content remains on Ombaverse. If you remove Your Content, this license terminates, except for copies reasonably needed for backup or that have been shared by other users before removal.

You may publish Your Content on other platforms simultaneously. We do not require exclusivity.

We will never:

• Claim ownership of Your Content
• Create derivative works from Your Content without your explicit permission
• License Your Content to third parties for adaptation (film, TV, games, merchandise) without a separate agreement with you
• Prevent you from removing Your Content at any time

4. Content Guidelines

You agree not to upload content that:

• Infringes copyright, trademark, or other intellectual property rights
• Contains sexualized depictions of minors
• Constitutes harassment, threats, or incitement to violence against real people
• Contains personal information of others without consent
• Is spam, malware, or deceptive

We reserve the right, but have no obligation, to review and remove content at our sole discretion. We may add content warnings, age ratings, or restrict visibility of content.

5. Copyright and DMCA

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). See our Copyright Policy for details on how to submit takedown notices and counter-notifications.

Repeat Infringer Policy: In accordance with the DMCA, we terminate the accounts of users who are repeat infringers. Two or more valid DMCA notices may result in permanent account termination. We may terminate accounts after a single notice in egregious cases.

6. Payments and Creator Earnings

Ombaverse offers multiple ways for creators to earn:

• Tips: 100% goes to the creator. Ombaverse takes 0% (payment processing fees may apply).
• Subscriptions: Premium subscribers' payments are distributed to creators they actually read, proportional to reading time (user-centric royalties). Ombaverse retains 20%; 80% flows to creators.
• Ad revenue: Creators receive 70% of ad revenue generated by their content.

Payments are processed through third-party providers (Stripe, MTN Mobile Money, Airtel Money). We are not responsible for third-party payment processing issues. Minimum payout thresholds may apply.

7. Verse Universes

Verse Universes allow creators to build shared creative worlds. If you submit fan works to a Universe, you agree to that Universe's terms as set by its creator. You retain ownership of your fan works.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OMBAVERSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100 USD.

10. Indemnification

You agree to indemnify and hold Ombaverse harmless from claims arising from your use of the Service, your content, or your violation of these Terms.

11. Dispute Resolution

These Terms are governed by the laws of Uganda. We encourage informal resolution first (30 days). Unresolved disputes proceed to binding arbitration. You may opt out of arbitration within 30 days of accepting these Terms. Class action waiver applies.

12. Changes

We will notify you of material changes at least 30 days in advance via email or platform notice. Continued use after the effective date constitutes acceptance.
